摘 要:与普通英语相比,法律英语有自己的文体特征即:精确、正式、简洁、规范.状语在法律英语文本中的特殊用法是体现其文体特征的重要方面之一.本文中,作者将从复杂的状语结构和状语成分的位置两方面分析状语在法律英语中的文体特征.

1.前言
法律英语是以英语共同语为基础,在立法和司法等活动中形成和使用的具有法律专业特点的语言.(张新红,2002)在正式的法律条规和文本中,对某一法律概念成立的限定条件很多,这些限定条件有很多是以状语的形式存在的.法律英语中的状语不仅长,而且结构复杂,位置特别.“从而使法律英语句子的长度句子远远超出英语句子的平均长度(17个词),有时一个段落由一、两句话组成,句子结构比较复杂,往往包含较多的从句和修饰语,正因为如此法律文件显得罗索难懂.”(王佐良、丁往道, 1985: 287)
2.复杂的状语结构
作为对动词和句子的修饰语,状语分为以下九类:时间状语、地点状语、方式状语、目的状语、原因状语、结果状语、条件状语、让步状语和伴随状语.然而法律英语中状语的使用,其复杂性主要存在于时间状语、条件状语、方式状语和目的状语中.因为法律文件的制定是用来控制和约束的,大量重要的信息应当附有时间、条件、方式和目的的限制.
2.1 时间状语
普通英语中,时间状语可以放在句首、句中和句末.然而在法律英语中为了达到精确而避免模糊,状语的位置总是靠近它所修饰的动词.例如:
(1) (EXW) B7 Notice to the seller
The buyer must, whenever he is entitled to determine the time within an agreed period and / or the place of taking delivery, give the seller sufficient notice thereof. (Incoterms 2000)
2.2条件状语
普通英语中条件状语的位置十分灵活,它可以指假定条件、先决条件或例外条件.不管哪种条件,条件状语可以放在句首、句中和句末.指假定条件时,经常用引导词“if,in case, in the event of ”等.当指先决或例外条件时,经常用引导词如“provided ,except,,unless,”等.
下面是从International Convention for the Unification of Certain Rules of Law Relating to Bills of Lading and Protocol 选取的两个例子:
(2) (Article 3) 6. 等In case of any actual or apprehended loss or damage the carrier and the receiver shall give all reasonable facilities to each other for inspecting and tallying the goods.
(3) (Article 6). 等Any agreement so entered into shall he full legal effect provided that this article shall not apply to ordinary mercial shipments made in the ordinary course of trade, but only to other shipments where the character or condition of the property to be carried or the circumstances, terms and conditions under which the carriage is to be performed are such as reasonable to justify a special agreement.
例(2)中的状语是指假定的条件.例(3)是指先决和例外条件.而且,从以上两个例子我们还可得知这样一个基本的句型:” If A, then B shall be C” or “If A, then B shall do C”.
2.3方式状语
法律文件通常要涉及到双方当事人共同达成协议的履行,不仅涉及履行的结果也涉及履行的方式.比如说交货日期和交货方式.因为对履行方式的规定附有大量的重要信息,其中任何的疏忽都可能导致协议的破裂.因此尽可能清楚明白的表述句中的这一部分是非常必要的,所以方式状语在很大程度上增加了法律文本中句子的长度和复杂性.例如:
(4) (FCA) A4 Delivery
The seller must deliver the goods to the carrier or another person nominated by the buyer, or chosen by the seller in accordance with A3 a), at the named place on the date or within the period agree for delivery. (Incoterms 2000)
2.4目的状语
目的状语是用来规定履行合同、协议等各方当事人义务的.它经常出现在这些引导词后,如:“in order to, so as to or so (such)等 that”.如果引导词是“in order to, so as to”,状语可以放在句首或句末.如果引导词是“so (such)等 that”, 状语大多数情况下只能放在句末,因为比较而言这一部分是次重要的.例如:
